Based on the results of two previous smaller First Action Interview pilot programs, the benefits include expanding the program to include all utility applications in all technology areas and of any filing date, hastening the prosecution of an application, reducing pendency and enhancing interaction between the applicant and the examiner.

The pilot program also provides an opportunity to resolve patentability issues one-on-one with the examiner early in the process and creates the opportunity to facilitate an early allowance.

For applications in the new program, which runs until May 16, 2012, the examiner will conduct a prior art search and provide the applicant with a Pre-Interview Communication – a condensed Office action that sets forth any proposed claim rejections and objections.

Once received, the applicant schedules an interview to discuss the examiner’s proposals along with proposed amendments or arguments. This early interview increases the likelihood for an early allowance of the application.

Applications in the two previous smaller pilot programs had a First Action allowance rate 300% higher than applications from the same technology area not participating in the pilot and for applications that were not allowed on the First Action, there were typically fewer communications between the applicant and the examiner needed to reach a final disposal.
